These Terms and Conditions ("Terms") govern your access to and use of the EpiphanyApps platform located at https://apps.epiphanyassociates.com (the "Service"), operated by Epiphany Associates ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
You must be at least 18 years of age and have the legal authority to enter into these Terms on behalf of yourself or the organization you represent. By creating an account, you represent and warrant that you meet these requirements.
The Service is provided for lawful business purposes related to case management, milestone tracking, and organizational workflow. You agree not to:
You retain ownership of all data, content, and information you submit to the Service ("Your Content"). By using the Service, you grant us a limited, non-exclusive license to store, process, and display Your Content solely for the purpose of providing and improving the Service. We will not use Your Content for any other purpose without your consent.
You are solely responsible for the accuracy, legality, and appropriateness of Your Content. You represent that you have all necessary rights to submit Your Content to the Service.
The Service may send you notifications via email and SMS based on your preferences. By enabling SMS notifications, you consent to receive text messages at the phone number you provide. Message frequency varies based on your selected cadence. Message and data rates may apply. You may opt out of SMS at any time by updating your notification preferences within the Service.
If you create or administer a team account, you are responsible for managing team membership, roles, and permissions. You acknowledge that team members may access shared data within the account based on their assigned roles. Inviting a user to your team constitutes your authorization for that user to access team data as permitted by their role.
The Service, including its design, features, code, documentation, and branding, is owned by Epiphany Associates and protected by intellectual property laws. Nothing in these Terms grants you any right, title, or interest in the Service beyond the limited right to use it in accordance with these Terms.
The Service integrates with third-party providers (including Supabase, Resend, Twilio, and others) to deliver functionality. Your use of the Service may be subject to the terms and policies of those providers. We are not responsible for the practices or availability of any third-party service.
We strive to keep the Service available and reliable but do not guarantee uninterrupted or error-free operation. We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will make reasonable efforts to notify you of material changes.
To the maximum extent permitted by law, Epiphany Associates and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of or related to your use of the Service, regardless of the theory of liability.
Our total liability for any claim arising from or related to these Terms or the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or one hundred dollars ($100), whichever is greater.
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will meet your requirements or that it will be uninterrupted, secure, or error-free.
You agree to indemnify and hold harmless Epiphany Associates, its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (including intellectual property, limitation of liability, and indemnification) will remain in effect.
These Terms shall be governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in Utah.
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the effective date. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
